10/02/2017-Apprived City Commission Regular Meeting Minutes


MONDAY 

OCTOBER 02, 2017 

The Governing Body of the City of Pratt met in Regular session in the Commission Room located in City Hall.

CALL TO ORDER: 

The regular meeting was called to order by Mayor Kumberg.  The Mayor instructed the City Clerk to note that all Commissioners were present.

The Mayor reminded the audience that this meeting may be taped and/or recorded.

INVOCATION AND PLEDGE OF ALLEGIANCE:

Commissioner Meyer led the staff and audience in the invocation and Mayor Kumberg led the Pledge of Allegiance.

MINUTES:

Commissioner Hlavachick made a motion to approve the minutes of the September 18, 2017 City/County Joint Commission meeting and the September 18, 2017 regular Commission meeting.  The motion was seconded by Commissioner Meyer and carried unanimously.  

BUSINESS: 

CONSIDERATION AND APPROVAL OF REZONING OF 601 E. 1ST: 

Building Inspector Blankenship stated that the Planning and Zoning Commission met on September 21st and did a lot split and rezoning of the American Legion property.  Mr. Blankenship added that it was done correctly and the lot split ends with the Planning Commission; however, the rezoning was a recommendation from the Planning Commission to the City Commission.  Mr. Blankenship explained that you had to be careful when doing a lot split and rezoning so that you did not make an illegal lot.  Mr. Blankenship stated that the only zoning that would work for this situation was office and institutions  Mr. Blankenship commented that C-O fits the neighborhood.  Commissioner Schmidt made a motion to approve the rezoning of 601 East Third Street as presented by Building Inspector Blankenship.  The motion was seconded by Commissioner Hlavachick and carried unanimously.

OPEN AGENDA: 

·        Oktoberfest: 

Mr. John Beverlin and Mr. Dakota Holtgrieve thanked the Commission for the use of Green Sports Complex for Oktoberfest.  Mr. Beverlin commented that they had not had time to put all the numbers together, but felt they had a good turnout.  Mayor Kumberg thanked them for putting on something different in town and that he had had a good time.

REPORTS: 

·        Meeting in Hays: 

City Manager Eckert stated that he had a water conservation meeting in Hays on the 13th and Water Superintendent Clay would be going with him.  Mr. Eckert commented that it should be a good conference. 

·        KMEA Conference: 

Mr. Eckert informed the Commission that he would be attending the KMEA Conference on the 19th; however, he also had a water board meeting that morning.  Mr. Eckert stated that he would get there late, but Director of Electric Utilities Huber, Mr. Kenny Kreutzer and Commissioner Hlavachick would be there for the whole conference.

·        ED Director: 

Mayor Kumberg stated that the Commission had met with the County Commission earlier today and discussed the ED Director position.  Mayor Kumberg added that both Commissions felt that they need to focus on that position and he was impressed with their headway. 

City Attorney: 

City Attorney Goff stated that she continued to do research and do Municipal Court things.  Commissioner Meyer stated that he had attended court and they had a full docket.  Commissioner Meyer commented that they all work together seamlessly.

Public Works: 

·        Loren Minnis Park:

Public Works Director Rambat stated that he had a couple of inquiries about making some improvements to the park on Jackson Street and Main Street.  Mr. Rambat commented that they would like to see the City install a half-court basketball court.  Mr. Rambat explained that there were not many places in Pratt to do that.  Mayor Kumberg suggested that it be given to the Park and Recreation Advisory Board.  Recreation Director Pinkall stated that Park Superintendent Eckhoff had discussed it with them and had told them that there used to be one there.  Mr. Rambat stated that he would work up a cost for the improvement to the park. 

·        Clean-Up of Shelter Houses: 

Mr. Rambat stated that Mr. Eckhoff had mentioned to him that something needed to be done on the clean-up of the shelter houses after an event.  Mr. Rambat commented that part of the wedding decorations from last weekend were in the park and they had entertained the idea of doing a deposit.  Mr. Rambat suggested a good slim line form to rent the shelter house and then it might make them liable to clean-up before they leave.  Commissioner Peters questioned what a reasonable deposit would be.  Mr. Rambat stated that he thought around $50 because that made it stiff enough that they would want to get it back.  Commissioner Peters asked if the City would have someone go check it if the event was done at 8:00 p.m.  Mr. Rambat stated that we could do that.  Commissioner Hlavachick suggested sending this to the board, as well, because he thought that there were restrictions on what we could charge for in Lemon Park.  Mayor Kumberg stated that it should be left to staff to do this as a policy.

·        Sidewalk project: 

Mr. Rambat stated that Arensdorf Construction was about a quarter of the way done with the sidewalk project.  Mr. Rambat explained that the weather last week had kept them from making any headway and the forecast for this week was not much better.

·        Chip Seal project:

Mr. Rambat stated that the chip seal project was complete. 

·        Sidewalk on 6th Street: 

Commissioner Schmidt asked about the sidewalk that was torn up on Sixth Street.  Mr. Rambat stated that that was a homeowner that wanted to remove the sidewalk himself because he had just planted grass.  Mr. Rambat commented that it would be replaced by the end of the year. 

Building Inspections: 

·        Lemon Park project:

Building Inspector Blankenship stated that he had received a letter from Ms. Katie Westerhaus, Land and Water Conservation Grant Coordinator, and the Lemon Park bathroom project was not chosen to receive any grant money this year. 

·        McDonald’s: 

Mr. Blankenship stated that McDonald’s had new owners so he was not sure where the new building was at.  Mr. Blankenship commented that he had not been contacted by any engineers for that project.

Recreation Department: 

·        Dog Park:


Recreation Director Pinkall stated that the Park and Recreation Board had met last Monday and discussed the dog park.  Mr. Pinkall stated that they had received location suggestions from Mr. Eckhoff and they felt that Sixth Street Park was conducive.  Mr. Pinkall commented that the area suggested would line itself with diamond two and had shade, a picnic table and an area between the fields for parking.  Mr. Pinkall stated that there was also a restroom there; however, it had not been open for several years.  Mr. Pinkall reminded the Commission that the fence for the dog park was being donated.  Commissioner Peters asked if there was a liability policy if someone had to break up a fight and got hurt.  City Attorney Goff stated that the owner brought the dog to the park and they would have first liability; however, she would check with Sanders Insurance.  

Police Department:

Mayor Kumberg questioned where the Municipal Court money goes.  Chief Myers stated that part of it goes to the Law Library.  Finance Director Garten stated that it goes to the general fund and a percentage goes to the State each month.  Ms. Garten added that it helps pay for the police department, City Attorney and Municipal Court. 

Finance Department: 

·        Sales tax: 

Ms. Garten stated that sales tax was down. 

Mayor and Commission: 

·        Oktoberfest: 

Mayor Kumberg thanked everyone that helped make Oktoberfest a success.  Mayor Kumberg commented that it was a fantastic change of what we usually do. 

·        Linemen: 

Commissioner Hlavachick stated that he appreciated Mr. Huber and the other linemen for helping out Florida.  Commissioner Hlavachick added that they had made some friends while they were there. 

·        Oktoberfest table:

Commissioner Meyer suggested that the City sponsor a table at next year’s Oktoberfest so that the City was represented. 

Executive Session #1: 

Mayor Kumberg made a motion to go into executive session for fifteen minutes for confidential data relating to financial affairs or trade secrets of second parties.  The motion was seconded by Commissioner Hlavachick and carried unanimously. 

Mayor Kumberg made a motion to return from executive session with nothing to report.  The motion was seconded by Commissioner Hlavachick and carried unanimously. 

Executive Session #2: 

Mayor Kumberg made a motion to go back into executive session for fifteen minutes for confidential data relating to financial affairs or trade secrets of second parties.  The motion was seconded by Commissioner Schmidt and carried unanimously.

Mayor Kumberg made a motion to adjourn.  Commissioner Hlavachick seconded the motion and it passed unanimously.
